Terms and Conditions of Use
These Terms and Conditions ('Agreement') govern your use of the Mayowish mobile application ('App') provided by Mayowish Private Limited ('Company'), an Indian startup. By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree with any part of this Agreement, you should not use the App.
1. User Eligibility
1.1 The App is intended for use by K3 students, teachers, and parents ('Users').
1.2 By using the App, you represent and warrant that you are at least 18 years old or have obtained parental consent to use the App.
2. App Services
2.1 The App provides 2D/3D tutorials, augmented reality (AR)-based experiences, and artificial intelligence (AI)-powered assessments to enhance STEM (science, technology, engineering, and mathematics) education.
2.2 The Company aims to provide an interactive and immersive learning experience through the App, enabling Users to explore complex concepts and gain a deeper understanding.
2.3 The App combines visual exploration, hands-on experience, and personalized assessments to create an effective learning environment.
2.4 Mayowish offers playful and educational STEM lessons, interactive games, and engaging activities to make STEM subjects enjoyable and engaging for Users.
2.5 Users may be required to use the camera feature of their device to participate in certain AR-based experiences and assessments.
2.6 The Company may provide worksheets or other educational materials within the App to supplement the learning experience.
3. User Responsibilities
3.1 Users shall provide accurate and up-to-date information during the registration process.
3.2 Users are responsible for maintaining the confidentiality of their login credentials and agree not to share their account with any third party.
3.3 Users shall use the App for lawful purposes and not engage in any activity that may harm the Company, other Users, or violate applicable laws or regulations.
3.4 Users shall not attempt to gain unauthorized access to the App or its systems or interfere with the proper functioning of the App.
3.5 When using the camera feature, Users shall respect the privacy and rights of others and only capture images or videos in compliance with applicable laws and regulations.
4. Intellectual Property
4.1 The App and its content, including but not limited to text, graphics, images, videos, and software, are owned by the Company and protected by intellectual property laws.
4.2 Users are granted a limited, non-exclusive, non-transferable license to use the App and its content for personal, non-commercial purposes only.
4.3 Users shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the App.
5. Privacy
5.1 The Company respects the privacy of its Users and processes personal data in accordance with applicable data protection laws and its Privacy Policy.
5.2 By using the App, Users consent to the Company's collection, use, and disclosure of personal data as described in the Privacy Policy.
6. Disclaimer of Warranties
6.1 The App and its content are provided on an 'as is' and 'as available' basis without warranties of any kind, whether express or implied.
6.2 The Company does not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

7. Limitation of Liability
7.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the App.
7.2 The Company shall not be liable for any damages resulting from the use of the camera feature, including but not limited to any unauthorized use, misuse, or infringement of the rights of others.
7.3 The Company shall not be responsible for any loss or damage to worksheets or educational materials provided within the App.
8. Indemnification
8.1 Users agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with the User's use of the App or any violation of this Agreement.
9. Governing Law and Jurisdiction
9.1 This Agreement shall be governed by and construed in accordance with the laws of India.
9.2 Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Jaipur Rajasthan
10. Modification of Terms
10.1 The Company reserves the right to modify or update these Terms and Conditions at any time without prior notice.
10.2 Users are encouraged to review the most current version of the Terms and Conditions regularly. Continued use of the App after any modifications or updates shall constitute acceptance of the revised Terms and Conditions.
11. Severability
11.1 If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
12. Entire Agreement
12.1 This Agreement constitutes the entire agreement between the User and the Company regarding the use of the App and supersedes any prior or contemporaneous agreements, understandings, or representations.
By using the Mayowish mobile application, you acknowledge that you have read, understood, and agreed to the above Terms and Conditions. If you do not agree with any part of this Agreement, you should not use the App.
